- The FCA welcomes lenders making early settlement offers to affected car finance customers.
- Barclays becomes the first major lender to begin contacting claimants for early redress.
- The central compensation scheme faces legal hurdles with a court hearing set for February.
Car owners in the UK may receive early compensation offers ahead of the resolution of the ongoing car finance mis-selling dispute. The Financial Conduct Authority regulator stated it would support lenders issuing settlement offers, provided that customers are not placed in a worse financial position compared to its proposed central compensation scheme.
That central scheme is currently facing legal challenges, with a scheduled court hearing in February 2026, meaning actual compensation payouts are unlikely to be disbursed until late next year. Nevertheless, Barclays has confirmed it will initiate early compensation offers immediately, with other lenders anticipated to follow suit.

The FCA indicated that only a minority of claimants will receive these early offers, while the majority will need to wait for the final outcome of next court proceedings next year. The vast majority of new and second-hand automobiles are purchased through financing agreements, requiring an initial deposit followed by monthly installments including interest charges.
Millions of drivers who secured car loans between April 2007 and November 2024 are entitled to redress following the mis-selling of these agreements. The controversy primarily stems from discretionary commission arrangements, where car dealerships received commissions from lenders based on the interest rates charged to customers without proper disclosure.
Total industry compensation costs are projected to reach up to 9.1 billion pounds, including administrative expenses. Individual payouts will vary depending on the degree of financial harm experienced by each driver, prompting several lenders to set aside multi-million pound provisions.
"By making these early settlement offers, we are giving some customers the option of receiving redress sooner, rather than waiting for the legal challenges and any subsequent FCA action to conclude"

From an industry perspective, the car finance mis-selling scandal represents one of the most substantial consumer redress crises in the UK since the historic PPI (Payment Protection Insurance) payouts. Barclays' decision to settle early highlights a strategic move to clear liabilities from balance sheets and mitigate long-term reputational damage, bypassing the lengthy delays associated with the upcoming tribunal hearings.
The FCA has published an informative factsheet to assist drivers in determining whether to accept early settlements from lenders, including an official directory to prevent fraud. The regulator emphasized that accepting an early payout removes the claimant from the central scheme, forfeiting any opportunity to pursue higher compensation should subsequent legal challenges yield larger payouts.
