The Department of Provincial Administration has stepped up regulatory measures for foundations across Thailand. On November 7, Narucha Khosasivilai, Director-General of the Department of Provincial Administration, announced new operational guidelines aimed at protecting public interest, maintaining public trust, and enhancing transparency and accountability in asset and donation management.
Under this new announcement, all foundations in Thailand are legally required to compile and submit their annual operating results to the foundation registrar. Narucha emphasized that any public fundraising or donation drives must receive official authorization beforehand. Violators will face legal action, serving as a safeguard to prevent foundations from being exploited as tools for illicit personal gain.
Implementing digital reporting through the i-Service platform marks a crucial step in closing regulatory loopholes where charitable organizations might otherwise be misused for financial malpractice. Requiring certified public accountant validation on balance sheets ensures donors that contributions genuinely support public welfare objectives.
Regarding the compliance requirements, foundations must compile three mandatory documentation items for their annual filings:
- A comprehensive report on the foundation's activities from the past year.
- Income and expense accounts along with a copy of the balance sheet certified by a licensed public accountant.
- Copies of minutes from all foundation board committee meetings held during the period.
Foundations can submit these required performance reports and documents to the registrar either by delivering them in person or by utilizing the digital i-Service system provided by the Department of Provincial Administration.
