The creator of ChatGPT is pushing back hard against legal pressure from Cupertino, formally asking a federal judge to throw out Apple's high-profile lawsuit. Several core arguments from a company blog post published on Tuesday titled "Apple is getting this wrong" have now made their way into formal legal arguments. In that post, OpenAI characterized Apple's legal actions as careless, aggressive, and oddly personal, a sentiment that now permeates its official court filings.
This high-stakes legal confrontation highlights the fierce corporate war for top-tier artificial intelligence talent. While established tech giants rely on strict non-disclosure agreements and trade secret claims to protect their intellectual property, fast-moving AI innovators argue these lawsuits often mask a deeper failure to retain talent and keep pace with rapid advancements in machine learning.
Addressing specific allegations, OpenAI defended Chang Liu, a former Apple staffer now employed by the AI startup. Although Apple accused Liu of downloading confidential files after his departure, OpenAI countered that he was merely assisting former colleagues who reached out to him for help.
"Apple should not be permitted to use a baseless and pretextual lawsuit to make up for its shortcomings in the market for talent and retaining its employees, and its failures to integrate AI into its products"

In its dismissal filing, OpenAI didn't hold back in criticizing Apple's broader motivations, arguing that the lawsuit serves as a pretextual smoke screen to cover up Apple's own shortcomings in retaining employee talent and integrating AI capabilities into its consumer ecosystem. The company emphasized that it naturally attracts top engineers because it offers genuinely innovative work.
The presiding judge is set to hear formal arguments concerning the dismissal motion on October 1st. Meanwhile, Apple has pushed forward with its own procedural moves, having requested a preliminary injunction to prevent OpenAI and the named employees from accessing or utilizing any disputed confidential materials while the litigation proceeds.
